INTERGEL SETTLEMENT - PRODUCT LIABILITY

Lifecore Biomedical, Inc. of Chaska, Minnesota, manufacture ‘Gynecare Intergel Adhesion Prevention Solution’ which was used to help reduce post-operative internal scarring that led to intestinal obstruction, adhesions and chronic pain. The product is marketed by Johnson & Johnson’s Gynecare unit and on March 27, 2003 international sales were suspended when doctors were sent a letter stating that the company had received reports of problems.

The product was withdrawn from the global market and customers were advised to stop using it immediately and Gynecare requested that all product and samples be returned to them. At that time the FDA had reports of 72 “adverse events,” including 3 deaths and 48 injuries among U.S. patients who had been treated. Patients have complained of late-onset post-operative pain, non-infectious foreign body reactions and tissue adherence necessitating repeat surgeries following the onset of discomfort.

Gynecare maintain that many of the reported problems were associated with use in laparoscopic and non-conservative surgical procures, and that the product is not intended for use in laparoscopic surgery. The product information specifically states that Intergel has not been proven safe and effective in laparoscopy or in hysterectomy.
