MRSA LAWSUIT – MEDICAL MALPRACTICE
Infection by the bacteria known as Methicillin Resistant Staphylococcus Aureus can be as a result of medical malpractice. The consequences of exposure to this bacterium can include debilitating illness including paralysis and in extreme cases may be fatal. If you have been affected by this condition due to a healthcare professional’s negligence or due to unwitting exposure to unsanitary conditions you can instigate an MRSA lawsuit in order to claim damages and a compensation settlement.
It is estimated that almost 2 million Americans contract a drug resistant infection each year and that about 100,000 die from it. The most disturbing aspect of this problem is that the infection is in the main controllable and preventable. That being the case most acquired infection must be the result of malpractice or negligence which is sufficient to ground an MRSA lawsuit.
The most common drug resistant bacteria include :-
- methicillin resistant staphylococcus aureus
- psedomonas aeruginosa
- klebsiella pneumoniae
- vancomycin-resistant enterococcus faecium
- clostridium difficile
Infection can be acquired in a number of ways and several of these transmission routes can be the basis for legal action in an MRSA lawsuit :-
- hand carriage
- contaminated surfaces
- medical instruments
- airborne particles
- shared items
- shared needles
- sexual intimacy
Damages awarded in an MRSA lawsuit can include :-
- loss of past and future income
- pain and Suffering (including psychological damage)
- care and assistance for the past and for the future
- medical expenses for the past and for the future
- loss of amenities of life
Methicillin Resistant Staphylococcus Aureus (staph) infection is caused by the staphylococcus aureus bacteria which has over the years mutated to become resistant to broad-spectrum antibiotics that had previously been used to treat it. There is however still one form of antibiotic called ‘vancomycin’ that has varying degrees of success in effecting a cure. This bacterium is most often found in prisons and hospitals, frequently affects patients undergoing surgery and is usually transmitted through poor hygiene. Transmission rates can be dramatically reduced by the use of simple precautions including hand washing and scrupulous care of toilets and sanitary installations.
Ordinary staph bacteria are found on the skin or in the nose of about 30% of the population. It is not normally problematic and is generally harmless unless the infection enters the body through a cut or a wound particularly of someone who is vulnerable or who has a compromised immune system. A drug resistant form of the bacteria which was previously usually hospital acquired is now also found in the wider population and is known as ‘community associated MRSA’
